Welcome and thank you for visiting the website (www.geojam.com) and/or using the social media platform and app to connect with creators (collectively the “Platform”), by Geojam, Inc. (“Geojam”, “we”, “our”, “us”, or “Company”)! Our Platform is intended to reward fans for discovering and engaging with creators of any variety, including music artists, athletes, and many more (collectively “Creators” and each individually a “Creator”), and provide such Creators the ability to directly connect with you the interested fan and offer content and products/experiences—creating new revenue streams that directly benefit such Creators.

This privacy policy (“Privacy Policy”) is effective as of the date shown above, describes our information collection, use, sharing and management practices in connection with the Platform, as well as any circumstances under which we may disclose information collected from you.

Please be advised that the practices described in this Privacy Policy apply only to information gathered by us when you use our Platform. It does not apply to any information you provide to third-party platforms and services used in conjunction with our Platform, such as and without limitation Spotify, the Apple App Store, or social media services or streaming services.

  1. THE INFORMATION WE COLLECT ABOUT YOU

    In order to use our Platform, we may need to collect certain information about you that can or could be used to identify you (“Personal Data”). We may collect and use the following Personal Data to provide the Platform to you and fulfill obligations with you under our terms and conditions or if you are a Creator, any other agreement entered directly with you. Such information may be provided to us by you voluntarily, collected by us automatically, or provided to us from third parties.

    • Information You Voluntarily Provide To Us

      To maximize your user experience, we may ask you to provide information about yourself at various times over the course of your use of the Platform, including but not limited to, when you create an Account, register with a Creator as a fan, post on the Platform or other social media sites, redeem rewards, make a purchase, subscribe to our publications or subscriptions, or otherwise communicate with us. Such information may include to following categories of information:

      • Contact Data, including your first and last name, email address, postal address, and phone number.

      • Account Credentials, including your username, password, and information for authentication and account access.

      • Digital Wallet Information, including your private digital wallet address.

      • Billing Data, including your payment instrument number (such as a credit or debit card number), expiration date, and security code as necessary to process your payments. Geojam will not capture, record or in any way store or process your payment account details for the form of payment used in these transactions. However, our third-party processor may share non-sensitive financial or billing information (e.g. records and receipts) with us in order for us to verify and complete transactions and track and process payments for any fees collected by such third parties.

      • Content, including any personal data in communications made while using the Platform, such as content within any messages you send to us (e.g., feedback and questions to customer support) or information you publicly post on the Platform.

    • You may choose to voluntarily provide other information to us that we do not request, and, in such instances, and in such situations we have no control over what categories of Personal Data such disclosure may include. Any additional information provided by you to us is provided at your own risk.

    • Information We Receive From Third Parties
      We also collect information from other sources. The following are the categories of sources we collect information from:

      • Third-Party Interactive Services, including streaming services, social networking sites and other online interactive services like bulletin boards, chat rooms, blogs, and online forums. We receive information from Third Party Interactive Services when you engage with our content, reference our Platform, or grant us permission to access information from the Third Party Interactive Service. For more information about connecting your accounts with Third-Party Interactive Services and the Platform, see the Section entitled “ Connected Third-Party Interactive Services ” below. Such information may include the following:

        • Interaction Data including plays, likes, or other data points related to your interaction with certain content of Geojam and/or a Creator;

        • Tokenized Account Data to verify your account within such Third-Party Interactive Service; and

        • Voluntarily Provided Data that you provide to a Third-Party Interactive Service and authorize to be shared with Geojam.

      • Customers or users of the Platform such as your friends and others that use the Platform, may provide us information when they submit content to us or post on the Platform. Additionally, we may, from time to time, supplement the information we collect directly from you on our Platform with outside records from third parties for various purposes, including to enhance our ability to serve you, to tailor our content to you and to offer you opportunities that may be of interest to you.

      • Publicly-Available Sources, including data posted on the applicable blockchain that is utilized by the Platform and other sources that may be available in the public domain.

    • Information We Collect Automatically

      Whenever you interact with the Platform either on a Geojam owned website or through a Third-Party Interactive Service, we may collect certain information about your use and device automatically, as well as use various tracking technologies that automatically collects information about how you access and use the Platform, which may include the following categories of information:

      • Platform Use Data, including data about features you use, pages you visit, emails and advertisements you view, products and services you view and purchase, the time of day you browse, and your referring and exiting pages.

      • Device Data, including data about the type of device or browser you use, your device’s operating software, your internet service provider, your device’s regional and language settings, and device identifiers such as IP address and Ad Id.

      • Location Data, including imprecise location data (such as location derived from an IP address or data that indicates a city or postal code level) and, with your consent, precise location data (such as latitude/longitude data).

      • Log Files, which are files that record events that occur in connection with your use of the Platform.

      • Cookies, which are small data files stored on your device that act as a unique tag to identify your browser. For more information about the cookies we use, please see the Section entitled “ Cookies ” below.

      • Pixels (also known as web beacons), which are types of code embedded in a website, video, email, or advertisement that sends information about your use to a server. There are various types of pixels, including image pixels (which are small graphic images) and JavaScript pixels (which contains JavaScript code). When you access a website, video, email, or advertisement that contains a pixel, the pixel may permit us or a separate entity to drop or read cookies on your browser. Pixels are used in combination with cookies to track activity by a particular browser on a particular device. We may incorporate pixels from separate entities that allow us to track our communications, bring you advertising both on and off the Platform, and provide you with additional functionality, such as the ability to connect our Platform with your social media account.

      • App Technologies, which are technologies included in our apps that are not browser-based like cookies and cannot be controlled by browser settings. For example, our apps may include SDKs, which is code that sends information about your use to a server. These SDKs allow us to track our communications, bring you advertising both on and off the Platform, and provide you with additional functionality, such as the ability to connect our Platform with your social media account.

  1. HOW WE USE THE INFORMATION WE COLLECT ABOUT YOU

    We use the information we collect from and about you for a variety of business purposes, including:

    • to provide you with our Platform;

    • to improve our Platform and to customize your experience with the Platform;

    • to maintain your account;

    • to verify that you have completed actions to earn rewards;

    • to process payments related to purchase made on the Platform utilizing our third-party payment processors;

    • verify transactions on the blockchain related to purchases and use of the Platform;

    • to provide rewards in connection with Creators that offer a particular reward;

    • for internal business purposes;

    • to monitor and analyze trends, usage and activities;

    • to conduct research, including focus groups and surveys;

    • to send you advertising;

    • for any purposes disclosed at the time you provide your information;

    • for any purposes provided for in our Terms;

    • to send you technical notices, updates, security alerts, information regarding changes to our policies, and support and administrative messages.

    • to provide technical and customer support to you;

    • to offer new or additional features for our Platform;

    • to enforce our Terms;

    • to send you materials by email or via notifications, or other commutations;

    • to carry out anti-fraud or other measures prohibited under our Terms; and

    • to fulfill any other business or commercial purposes at your direction or with your notice and/or consent.

  2. Notwithstanding the above, we may use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law. For information on your rights and choices regarding how we use information about you, please see the “ Your Rights and Choices ” section below.

  3. SHARING OF PERSONAL AND NON-PERSONAL DATA

    We share information we collect in accordance with the practices described in this Privacy Policy. The types of entities we may have shared information with or may share information with in the future include the following:

    • Third Parties Providing Services On Our Behalf: In order to make various features, services and materials available to you through the Platform, perform analytics, process payments, host the Platform, respond to your requests and inquiries, and facilitate rewards, we may share your Personal Data with third parties that perform functions on our behalf (or on behalf of Creators or our Affiliates).

    • Affiliates: We share Personal Data with our related entities including parent and sister companies for business purposes such as customer support, marketing, product development, and technical operations.

    • Creators: We share Personal Data with Creators as it relates to their specific events and Rewards. In particular, Creators may create specific actions User Actions or Rewards which may require you to submit Personal Data to the Platform which will then be shared with Creators. If you do not wish to share the requested information, your remedy is to not take the User Action or get the Reward.

    • Blockchain Platform: When you engage in a transaction that is recorded on the blockchain, certain information that may be considered personal information related to that transaction will be published on the blockchain and may be accessible to third parties not controlled by Geojam. Transactions recorded on the blockchain permanently recorded across a wide networks of computer systems and is generally incapable of deletion. Many blockchains are open to forensic analysis which can lead to deanonymization and the unintentional revelation of personal information, especially when blockchain data is combined with other data.

    • Your Agreement To Have Your Personal Data Shared: While using the Platform, you may opt-in to the sharing of your information with a third party, including Creators and their Affiliates, or such third parties as social networking sites. If you agree to have your Personal Data shared, your Personal Data will be disclosed to the third party. Any Personal Data you disclose will be subject to the privacy policy of that third party, not Geojam.

    • Business Transfers: We share information in connection with, or during negotiations of, any proposed or actual merger, purchase, sale or any other type of acquisition, business combination of all or any portion of our business or assets, change of control, or a transfer of all or a portion of our business or assets to another third party (including in the case of any bankruptcy proceeding).

    • Legal Disclosure: Under certain circumstances, we may be required to cooperate with legal investigations and/or we may be subject to legal requirements to disclose information collected through the Platform, such as a by court or a governmental agency. Our policy is to provide such cooperation and comply fully with all such legal requirements. We may also disclose Personal Data to investigate any violation or potential violation of the law, this Privacy Policy, or the Geojam Terms and Conditions or to protect or defend the rights or property of Geojam or users of the Platform.

    • Facilitating Requests: We share information at your request or direction, such as when you choose to share information with a social network about your activities on the Platform.

    • Consent: We share information with notice to you and your consent.

  4. Notwithstanding the above, we may share non-personal data, such as aggregate user statistics, demographic information, and anonymized usage information with third parties (including Creators, Affiliates, and other partners, service providers and advertising partners) without your consent.

  5. CONNECTED THIRD-PARTY INTERACTIVE SERVICES

    You can login with, and post to many of your own social media and other application accounts on third party services through the Platform. To enable Platform features that require access to these accounts, you may be asked to provide us your access credentials for that third-party service. Geojam may store your access credentials and/or an access token or similar authorization credentials obtained from the third party service for any such account (collectively, “Connected Accounts”), so that you are able to access those third party services without entering your access credentials again. You are solely responsible for deciding which of your accounts on third party services you connect to the Platform. If you do not wish to provide Geojam access to any given account, you must cancel the access in your Geojam Account and not reconnect by declining to enter your credentials when prompted.

    If you choose to enable any Connected Accounts, you allow us to monitor any Connected Account and collect (or the third party to share) data about you and your activity through using your account credentials which you have provided to Geojam (collectively, “Connected Account Data”). Connected Account Data may include any data made available through the third-party service’s application programming interface (API) or publicly available on their service, such as your public identity on their service, the content of your social posts, play lists, lists of your friends and followers, “likes”, location and other activity and usage data.

    The information we collect about you through the Platform may also be supplemented with information from third parties, or we may provide third party interfaces or links on the Platform to facilitate your sending a communication from the Platform. When you use these third-party platforms, the third-party platforms may or may not provide us with information about you. We are not responsible for the terms, policies, disclosures or actions of any third-party platforms.

    In any case where we receive data about you from a third party or through a Connected Account, we will treat any personally identifiable information collected as Personal Data under the terms of this Privacy Policy, unless we have disclosed otherwise.

    We use TrueDepth API technologies (ARKit, with automatic estimation of the real-world directional lighting environment) to create AR effects within the App. The only use of this information is to provide valuable user features. None of the information collected by the TrueDepth API ever leaves the user’s device. We do not share information with third parties, do not store or process in any other way the data which we accessed and used via TrueDepth API.     Please note that when you interact with a Third-Party Interactive Service, or otherwise leave our Platform to use a third-party service, those third parties may independently collect information about you and solicit information from you. The information collected and stored by those entities remains subject to their own policies and practices, including what information they share with us, your rights and choices on their services and devices, and whether they store information in the U.S. or elsewhere. We encourage you to familiarize yourself with and consult their privacy policies and terms of use.

  6. ADVERTISING/BEHAVIORAL TARGETING

    We use analytics services to help us understand how users access and use the Platform. In addition, we work with agencies, advertisers, ad networks, and other technology services to place ads about our and/or Creator’s products and events.
    As part of this process, we may incorporate tracking technologies into our own Platform (including our website and emails) as well as into our ads displayed on other websites and services. Some of these tracking technologies may track your activities across time and services for purposes of associating the different devices you use, and delivering relevant ads and/or other content to you (“Interest-based Advertising”).

  7. COOKIES

    • Types of Cookies
      We use the following types of Cookies:

      • Strictly Necessary Cookies: These are cookies that are essential to enable you to use the Platform, for example moving around our websites and using their features (e.g. cookies that enable you to log into the Platform).

      • Performance Cookies: These are cookies which collect information about how and when you and other visitors interact with our Platform (e.g. pages viewed most often) and the information collected by these cookies is used to improve how our Platform works.

      • Functionality Cookies: These are cookies that allow our Platform to remember choices you have made (such as your login information) and provide you with content and features which are customized to you. For example, providing you with relevant content by using a cookie to remember which region you are in.

      • Advertising Cookies: These are cookies which are used to deliver adverts to you which are more relevant to you and your interests. We may also share this type of information with third parties for these purposes.

    • The types of cookies described above may be “session cookies” or “persistent cookies”. Session cookies are only stored on your device whilst you are using the Platform, and are deleted when you log off from the Platform or close your browser. Persistent cookies remain on your device for a period of time after you log off from the Platform or close your browser.

    • Third Party Cookies
      Some cookies may be placed by third parties when you use the Platform as some third party service providers that we engage (including third party advertisers) may place their own cookies on your hard drive or Device. These cookies may provide information to those third parties about your browsing habits or may be used for security. Some also help to serve you with advertisements which are more relevant to you. Similarly, if you visit or use third party websites or services linked from our Platform, those third parties may place cookies or similar technologies on your device.

    • Cookies Settings
      You may decline cookies that are not Strictly Necessary. For more information about how to control your cookies settings, please see the section entitled “ Tracking Technology Choices ” in the “ Your Rights and Choices ” section below.

  8. YOUR RIGHTS AND CHOICES

    • Account Information

      You may access, update, or remove certain information that you have provided to us through your account by visiting your account settings or sending an email to the email address set out in the “ Contact Us ” section below. We may require additional information from you to allow us to confirm your identity. Please note that we will retain and use information about you as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

    • Communications

      • E-mails: You can opt-out of receiving promotional emails from us at any time by following the removal instructions in the specific communication that you receive, or emailing us at the email address set out in the “ Contact Us ” section below with the word UNSUBSCRIBE in the subject field of the email. Please note that you cannot opt-out of non-promotional emails, such as those about your account, transactions, servicing, or Company’s ongoing business relations.

      • Push Notifications: If you have opted-in to receive push notification on your device, you can opt-out at any time by adjusting the permissions in your device or uninstalling our app.

      • Text Messages: You can opt-out of receiving text messages or calls to your phone number at any time by (i) for text messages, texting “STOP” or other phrase specified in the opt out instructions of the text message, or by contacting us as set out in the “ Contact Us ” section below and specifying you want to opt-out of text messages.

    • Please note that your opt out is limited to the email address, device, and phone number used and will not affect subsequent subscriptions.

    • Unlinking Your Accounts From Third-Party Interactive Services
      If you have linked your account with certain other services, Third-Party Interactive Services, you may unlink your accounts through the respective service’s account settings. Please note that unlinking your accounts will not affect any information previously shared through the linking. Geojam is not responsible for the data practices of any other entities, and we recommend that you carefully review their privacy policies and terms of use.
      You may at any time request that we remove a Creator from your followed Creators, and end sharing of your information with that Creator as described above by modifying your account settings or sending us an email at contact@geojam.com. If a Creator is removed from your account, you will no longer be able to access the Platform functionality including any rewards.

    • Analytics and Interest Based Advertising
      The companies we work with to provide you with targeted ads are required by us to give you the choice to opt out of receiving targeted ads. Most of these companies are participants of the Digital Advertising Alliance (“DAA”) and/or the Network Advertising Initiative (“NAI”). To learn more about the targeted ads provided by these companies, and how to opt out of receiving certain targeted ads from them, please visit: (i) for website targeted ads from DAA participants,https://www.aboutads.info/choices; (ii) for app targeted ads from DAA participants,https://www.aboutads.info/appchoices; and (iii) for targeted ads from NAI participants,https://www.networkadvertising.org/choices/.
      Opting out only means that the selected participants should no longer deliver certain targeted ads to you, but does not mean you will no longer receive any targeted content and/or ads (e.g., in connection with the participants’ other customers or from other technology services).
      You may also limit our use of information collected from or about your mobile device for purposes of serving targeted ads to you by going to your device settings.
      Please note that if you opt out using any of these methods, the opt out will only apply to the specific browser or device from which you opt out. We are not responsible for the effectiveness of, or compliance with, any opt out options or programs, or the accuracy of any other entities’ statements regarding their opt out options or programs.

  9. Tracking Technology Choices

    • Cookies and Pixels. You may decline cookies that are not Strictly Necessary by clicking “Decline” in the cookie banner at the bottom of your screen. Additionally, although most browsers automatically accept cookies, you can change your browser options to stop automatically accepting cookies or to prompt you before accepting cookies. However, if you don’t accept cookies, you may not be able to access all portions or features of the Platform.

    • Do Not Track. Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to “Do Not Track” signals.     • App and Location Technologies. You can stop all collection of information via an app by uninstalling the app. You can also reset your device Ad Id at any time through your device settings, which is designed to allow you to limit the use of information collected about you. You can stop all collection of precise location data through an app by uninstalling the app or withdrawing your consent through your device settings.

  10. Please be aware that if you disable or remove tracking technologies some parts of the Platform may not function correctly.

  11. HOW WE KEEP YOUR PERSONAL DATA SAFE
    Geojam implements and maintains reasonable security measures to protect against the loss, misuse and unauthorized alteration of Personal Data in our possession and control. Please be aware that, although we endeavor to provide security for information in our possession and control, no security system can prevent against all potential security breaches, and we cannot guarantee the security of any information you transmit to us or that we store.

  12. CHILDREN’S PRIVACY
    The Platform is not intended for use by users under the age of 13. Geojam does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to create an Account on the Platform with or without parental consent. In the event that we learn that we have collected Personal Data from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us immediately at contact@geojam.com.

  13. CHANGES TO THIS PRIVACY POLICY
    Our Platform, business and third-party partners are constantly evolving. To that end, we may change, add or delete information on the Platform and/or this Privacy Policy from time to time. Any changes will be effective immediately upon the posting of the revised Privacy Policy, and we encourage you to check back regularly for any changes, additions or deletions. If the changes are material, in addition to posting the updates to our Privacy Policy on our website, we may provide you with notice to your current email address within the Platform, upon login to your Platform account, or other reasonable means. Your continued use of the Platform after any modification to this Privacy Policy will constitute your acceptance of such modification.

  14. CALIFORNIA SHINE THE LIGHT
    Customers who are residents of California may request (i) a list of the categories of Personal Data disclosed by us to third parties during the immediately preceding calendar year for those third parties’ own direct marketing purposes; and (ii) a list of the categories of third parties to whom we disclosed such information. To exercise a request, please write us at the email or postal address set out in “ Contact Us ” above and specify that you are making a “California Shine the Light Request.” We may require additional information from you to allow us to verify your identity and are only required to respond to requests once during any calendar year.

  15. INTERNATIONAL TRANSFER OF INFORMATION
    We operate the Platform in the United States, and Creators may be in the United States or other countries. If you are located outside of the United States, please be aware that information we collect may be transferred to and processed in the United States. By using the Platform, or providing us with any information, you consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen.
